Mallozzis lose court battle over Brown Derby rent

ALBANY -- A judge has ruled against Mallozzi Group in a long-running rent dispute, leaving the restaurant chain on the hook for a sum potentially exceeding $730,000.

The case involves the now-defunct Brown Derby, a restaurant the Mallozzis opened in 2008 on Clinton Avenue, near the Palace Theatre. Property owner University Development LLC sued in April 2013, charging that the Mallozzi Group LLC did not pay rent owed after it shut the place down in 2012. ...

State Supreme Court Judge Richard Platkin issued a default judgment in favor of University Development after finding the defendants had not complied with orders to provide information to the plaintiffs. He set a June 16 inquest at the Albany County Courthouse to determine the amount of damages the Mallozzis must pay. ...
